Individually-owned assets that have no beneficiary designation are subject to the probate process. There are circumstances when probate is not necessary. If a person's estate consists entirely of jointly-held assets, and/or assets with beneficiary designations, or if the estate is very small, the estate can sometimes be administered outside of probate.
